DETROIT — The Michigan Supreme Court ruled Monday that the federal government’s refusal to admit a Muslim into the U.S. violates her Fourth Amendment rights.
The three-justice majority says that a judge lacked the authority to order the federal government to accommodate a particular Muslim, who requested to be exempt from the immigration process. The Supreme Court expressly and correctly held that the ‘fundamental right of privacy in matters of intimate personal matters, and of marital status’ is a due process right protected by the Fourteenth Amendment,” the majority opinion states. “Although the defendant has not alleged that she was deprived of any specific substantive rights, the record shows the existence of the ‘fundamental right of privacy in matters of intimate personal matters’ that the Supreme Court held includes privacy in “marital status.”
Judge James Robart issued an injunction last month stating that only people who had criminal convictions (or who were granted a pardon, parole or discharge) from criminal activity (such as murder, manslaughter, etc.) would be allowed to enter the U.S., but would have to remain in the country for the duration of the lawsuit. The government appealed the ruling.
At noon Monday, Robart issued an order requiring the federal government to reconsider granting the Muslim non-citizens-only visitor’s visa application. The court gave the government 60 days to respond to the appeal.
